The president has no role in the administration of Federal elections under our Constitution, only the states subject to Congressional override. Congress has not given the president the authority to dictate to the Postal Service to pass a rule that says that unless states turn over their sensitive information to the federal government, the Postal Service won’t deliver mail-in ballots. By the way, the postal service itself is not given any statutory authority to enact the rule that it did.
Quite to the contrary. The rule with the U. S. mail service has been since the founding of this Republic that the Postal Service does not discriminate between types of mail.
The Postal Service plays no role in judging the content of the mail that goes through it. That is a core tenet of how the U. S. Postal Service is operated. It is a core tenant of the First Amendment.
But even beyond that, it is what you and I as citizens expect, right?
We want the Postal Service to be agnostic as to what we put on a postcard, what we put in an envelope, what we put on a birthday card. But here, the Postal Service has created a category of non-mailable mail, and that is ballots that are not sent to people from a list that has been coerced from the states to the federal government.
And since Congress hasn’t given that authority to the Postal Service, the Postal Service’s rule is invalid.
There are a handful of areas in which the Postal Service does have this power. For example, they can regulate explosives. They can regulate products that might cause harm. These are just pieces of paper, with names of candidates printed on them, and they do not pose any health risk to you. They don’t appear to be something that could harm you by exploding. The only one who has to fear people getting ballots would be a tyrant, a dictator, an authoritarian, like Donald J. Trump who wrote an Executive Order that was totally invalid, and goes against the Constitution.
And yet, that is exactly what the Trump executive order asked the Postal Service to do, and it is exactly what this postmaster general, and what this U. S. Postal Service agreed to do, and it is contained in that final rule.
Only in Trump’s America can or would this happen. Fortunately the U.S. Courts are protecting us because the people are tired of Trump’s tactics, his lies, his actions and everything he is doing to help himself and not the American people, but lastly now realize that if Donald J. Trump can change the Constitution, he would do it. Luckily the U.S. Congress has not followed his every whim. Only a tyrant, a dictator, or an authoritarian, which are now clear definitions of Donald J. Trump completely explain his unlawful actions, especially with his Executive Powers he creates with a stroke of a pen.
