A quiet policy shift within the Department of Justice (DOJ) has granted the Attorney General unprecedented, unchecked authority over federal prison placements. This change removes long-standing objective criteria based on public safety and criminal history, replacing them with total administrative discretion.
A policy change has taken place. Signed May 6th, 2026 by the Bureau of Prisons Director William Marshall, the new rule allows the Attorney General to transfer any federal prisoner to any facility nationwide.
There would be new discretionary power. Todd Blanche, if confirmed as Attorney General, would have the power to decide prison security without limits, checks, or judicial review.
Unprecedented political targeting would could occur. The policy could be used to place political opponents or protesters in maximum-security facilities alongside violent offenders.
This leads to preferential treatment. The rule facilitates “pay-to-play” scenarios or favorable placements (e.g. minimum-security camps or home detention) for political allies and wealthy individuals.
This sets precedent. The transfer of Ghislaine Maxwell to a minimum-security camp as an example of irregular placement that occurred even before this formal policy expansion.
